These Terms & Conditions govern your use of the website www.beyondthebasket.co.uk (“the Site”), which is operated by Beyond the Basket. By accessing or using the Site, you agree to be bound by these terms. If you do not agree, please do not use the Site.

1. Ownership & Copyright

All content on this Site, including but not limited to text, graphics, images, branding, and design, is the property of Beyond the Basket unless otherwise stated. Licensed content will be clearly credited where applicable. You may not copy, reproduce, distribute, publish, or create derivative works from any content without prior written consent.

2. Permitted Use

The Site and its content are provided for your personal, non-commercial use only. You may not:

  • Reproduce or republish any material from this Site without written permission;
  • Use automated systems (including bots or scrapers) to access or interact with the Site;
  • Distribute or share content from the Site or newsletter for commercial purposes.

3. Newsletter & Content Disclaimer

The content provided on the Site and through our newsletter is for informational purposes only. While we strive to ensure accuracy and relevance, we make no warranties or guarantees regarding the completeness, reliability, or suitability of any content. Beyond the Basket will not be liable for any direct or indirect loss or damage arising from the use or reliance on such content.

4. BTB Plus & Paid Tools

BTB Plus, including tools such as the deadline radar, the swipe file directory, the community, and any other paid features (together, “BTB Plus Tools”), is a paid subscription service made available in addition to the free Site and newsletter.

4.1 Accuracy of dated information. BTB Plus Tools may reference dates, deadlines, fees, or policy changes relating to third-party platforms and marketplaces. This information is compiled from publicly available sources for general reference only. We make reasonable efforts to keep it accurate and up to date, but third parties can change their own deadlines, fees, and policies at any time without notice to us. You are responsible for independently verifying any date, deadline, fee, or policy detail directly with the relevant platform or marketplace before relying on it or taking any action.

4.2 No liability for reliance. To the fullest extent permitted by law, Beyond the Basket will not be liable for any loss, cost, or damage arising from reliance on information provided through BTB Plus Tools, including missed deadlines or fees incurred as a result of inaccurate or outdated information.

4.3 Liability cap. Where liability cannot be excluded, our total liability to you in connection with BTB Plus Tools is limited to the amount you have paid for your subscription in the 12 months preceding the claim. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, or for fraud.

4.4 Errors. If you believe any information in a BTB Plus Tool is incorrect, please let us know at hello@beyondthebasket.co.uk so we can review and correct it. We are not liable for actions taken before an error is reported and corrected.

4.5 Subscription & cancellation. BTB Plus subscriptions are billed and managed through our third-party subscription platform, Beehiiv, with payments processed by Stripe. By subscribing, you also agree to Beehiiv’s and Stripe’s applicable terms governing payment and billing. You can manage or cancel your subscription at any time via the link provided in your subscription confirmation email or your Beehiiv account. Cancelling stops future billing; access to BTB Plus Tools continues until the end of the current billing period, after which access ends. We do not directly process or store your payment details.

4.6 Community. The BTB Plus community is provided as part of your BTB Plus subscription and is hosted on and operated through Beehiiv. Your use of the community is governed by Beehiiv’s terms of service and community guidelines, in addition to these Terms. Beyond the Basket is not responsible for the availability, moderation, or content of the community, or for the conduct of other members, beyond what Beehiiv’s platform provides.

5. Affiliate & Sponsored Content

Some content may contain affiliate links or references to sponsored products or services. We may earn a commission or receive compensation if you choose to engage with such links. This comes at no additional cost to you and helps support our work. We only promote products or services we believe may be of value to our readers.

6. Third-Party Links

The Site and newsletter may contain links to third-party websites, tools, or platforms that are not owned or controlled by Beyond the Basket. We are not responsible for the content, accuracy, terms, or privacy practices of any third-party sites. Visiting a linked site is at your own risk and subject to that site’s own terms and policies.

7. Availability

We make reasonable efforts to ensure the Site and newsletter service are accessible at all times, but we do not guarantee uninterrupted or error-free availability. We may suspend access for maintenance or technical reasons without prior notice.

8. Indemnity

You agree to indemnify and hold Beyond the Basket harmless against any claims, losses, damages, or costs (including reasonable legal fees) arising from your misuse of the Site, your breach of these Terms, or your violation of any third-party right, including intellectual property or privacy rights.

9. Privacy

Our collection and use of personal data is set out in our Privacy Policy, which forms part of these Terms. By using the Site, you also agree to the Privacy Policy.

10. Complaints

If you have a complaint or concern about the Site, the newsletter, or BTB Plus, please contact us in the first instance at hello@beyondthebasket.co.uk and we will do our best to resolve it promptly.

11. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Beyond the Basket regarding your use of the Site, and supersede any prior agreements or understandings, whether written or oral.

14. Changes to These Terms

We reserve the right to update or modify these Terms & Conditions at any time. Any changes will be effective immediately upon posting to this page. Continued use of the Site constitutes your acceptance of the revised terms.
